Kosciusko County prosecutors filed a felony charge of bestiality and a misdemeanor charge of trespassing against Phillip M. Butler on May 4. Kosciusko County police officers served a warrant on Butler Monday which led to his arrest.
According to court documents, Joe Moorehead Jr. Moorehead said Butler's truck was parked near the barn on the property April When Moorehead entered the barn, he told police detectives that he saw Butler with his pants down standing behind a female pony named "Duchess. Three years ago Moorehead told police his daughter caught Butler in the act, and one year ago, Moorehead's wife caught Butler doing the same, according to court documents.
Last fall, Moorehead said he caught Butler having intercourse with a pony, at which time, he told Butler to not come back on the property. Moorehead said he was even able to take pictures of Butler leading a pony into the barn, tying it up and standing behind it, court documents stated.
Police detectives said Butler admitted to having sex with a pony and that he takes it to the back of the shed so no one can see him. Elkhart Fire Department firefighters responded to a reported medical problem around 6 p. However, when entering the apartment, firefighters found that it was filled with smoke, according to a news release Wednesday.
Additional units were called to the scene, and firefighters were able to pull the unnamed occupant from the smoky apartment. The occupant was transported to Elkhart General Hospital for medical care. Firefighters determined the smoke in the apartment was caused by food left cooking on the stove. No open flames were found. The stove was turned off and fans were set up to clear the smoke from the apartment. Six seperate reports were taken. Kercher Road, Goshen, stating that someone burglarized the business.
